Article 2 Scope and acceptance

  1. These Terms of Use (“Terms”) govern every visit to and sale through the websites store.championspirit.com, championspirit.com and any sub-domain, together with any future web or mobile interface (the “Platform”).

  2. The Platform sells only physical goods: sports equipment, apparel, connected devices, packs and gift boxes (“Products”). No digital services or class-booking functions are available on the e-shop.

  3. By accessing the Platform or placing an order you acknowledge that you have read, understood and accepted these Terms and the separate Privacy & Cookie Policy (to be published). If you disagree with any clause, you must not use the Platform.

Article 3 Eligibility and account

  1. You must be at least sixteen (16) years old, or use the Platform under parental supervision.

  2. Creating an account is optional but recommended; you agree to provide accurate, current information and keep your credentials confidential.

  3. You are responsible for all activities carried out through your account. We may suspend or delete any account for breach of these Terms, fraud suspicion or legal requirement.

Article 4 Prices, taxes and customs

  1. Prices are shown in euros (EUR).

    • Deliveries inside the European Union: prices include French value-added tax (VAT).

    • Deliveries outside the EU: prices are VAT-exclusive.

  2. You are responsible for any customs duties, import VAT, brokerage or local taxes levied on entry into your territory (Delivered-At-Place / DAP).

  3. We do not collect United States sales tax. U.S. customers may owe use tax to their state.

  4. Shipping fees, if any, are displayed before checkout. Free-shipping thresholds are indicated when applicable.

Article 5 Payment

  1. Payment is accepted exclusively by credit/debit card through Stripe (Visa, Mastercard, American Express and others shown at checkout).

  2. The full amount is captured instantly; your order is deemed accepted and the sales contract concluded when we e-mail a confirmation.

  3. We reserve the right to refuse or cancel any order for legitimate reasons (stock shortage, payment failure, suspected fraud, legal restriction).

Article 6 Shipping, transfer of risk and title

  1. Orders ship from our French warehouse.

  2. Carriers & estimations

    • France: Colissimo / La Poste 2-3 business days

    • European Union: Colissimo, DHL or equivalent 3-6 business days

    • United States: DHL, FedEx or equivalent 5-8 business days

    • Rest of world: DHL, FedEx or equivalent 7-15 business days
      These times are indicative; delays beyond our control (customs, strikes, force majeure) do not entitle to compensation.

  3. Risk of loss transfers to you upon physical delivery. Legal title passes upon full payment of the purchase price.

Article 7 Right of withdrawal (EU consumers only)

  1. If you are a consumer residing in the European Union, you benefit from a 14-day cooling-off period under Directive 2011/83/EU and Articles L221-18 ff. of the French Consumer Code.

  2. The period runs from the day after physical delivery of the Product(s).

  3. To exercise, you must notify us unequivocally (e-mail or the form in Annex I) within the 14-day period.

  4. You bear the cost of return shipping. Products must be returned unused, in original packaging, with all accessories and documentation.

  5. We reimburse the price paid and the outbound standard-shipping cost within 14 days after receipt of the returned Products or proof of dispatch, using the same payment method.

  6. The right of withdrawal does not apply to:
    a) customised or clearly personalised items;
    b) sealed goods unsealed after delivery and unsuitable for return for hygiene or health protection reasons.

Article 8 Return policy outside the EU

For customers located outside the European Union, returns are accepted only if the item is defective or we shipped the wrong Product. You must notify us within thirty (30) days of delivery; you pay the return postage unless the error is ours, in which case we provide a prepaid label.

Article 9 Legal guarantee and warranties

  1. EU consumers enjoy the two-year legal guarantee of conformity (Articles L217-3 to L217-20 French Consumer Code).

  2. For all other customers we grant a commercial warranty limited to defects reported within thirty (30) days of delivery; statutory rights under mandatory local law remain unaffected.

Article 10 Intellectual property

  1. The Platform, trademarks, domain names, product designs, texts, photographs, graphics and source code are protected by intellectual-property laws and remain the exclusive property of Champion Spirit or its licensors.

  2. We grant you a non-exclusive, non-transferable, revocable licence to access and use the Platform for personal, non-commercial purposes. Any reproduction, extraction, adaptation or public communication requires our prior written consent.

Article 11 Personal data and cookies

  1. We collect and process personal data solely for: fulfilling orders, handling payments, preventing fraud, providing customer service and—if you consent—sending marketing communications.

  2. A full GDPR-compliant Privacy & Cookie Policy will be published separately and forms an integral part of these Terms.

  3. You may exercise your rights of access, rectification, erasure, restriction, portability and objection by writing to digitalmarketing@championspirit.com.

Article 12 Liability

  1. We are liable only for direct and foreseeable damage caused exclusively by our proven breach of contractual obligations.

  2. We are not liable for indirect or consequential loss, including lost profit, data, business or opportunity.

  3. Nothing in these Terms limits or excludes liability for death, personal injury caused by negligence, wilful misconduct or any liability that cannot be limited under applicable law.

Article 13 Force majeure

We are not responsible for non-performance or delays due to events beyond our reasonable control, including but not limited to natural disasters, fire, flood, epidemic, strike, supplier failure, war, governmental action, internet or power outage. Performance is suspended for the duration of the force-majeure event.

Article 14 Modification of the Terms

We may amend these Terms at any time. The new version is published on the Platform and takes effect immediately for new transactions. For ongoing orders, the version in force at the date of purchase applies. Material changes will be announced by banner or e-mail.

Article 15 Severability

If any provision is held invalid or unenforceable, the remaining provisions remain in full force and effect.

Article 16 Governing law and jurisdiction

These Terms are governed by French law without prejudice to mandatory consumer protection rules that may apply in your country of residence. Any dispute shall be subject to the exclusive jurisdiction of the Paris Commercial Court. EU residents may also submit their complaint on the EU Online Dispute Resolution platform (https://webgate.ec.europa.eu/odr). The French version prevails.
